TIRANA – “I will remain on duty until the successor is appointed. Appointments in the Supreme Court are not like in the Constitutional Court, they are not made with names, but with positions,” has said Ardian Dvorani, Chairman of Justice Appointments Council (JAC).
Dvorani made that comment while unveiling the legal arguments in relation to the termination of his mandate as member of Albania’s Supreme Court on Monday. He was tough enough rejecting to leave the office until his successor is appointed.
This stance defied the earlier request of President Ilir Meta who sent a letter to the High Court and the High Judicial Council (HJC) stating that Dvorani’s mandate as a member of the Supreme Court was over. Meta told these institutions that Dvorani could no longer be a member of the High Court or the head of JAC as his term of office ended in 2014.
Just before the deadline for arguments expired, Dvorani’s argument was handed over to HJC a day before this body holds a virtual meeting to review his mandate’s termination on Tuesday.
According to Dvorani, HJC does not have the attribute to deal with mandates.
