TIRANA, November 8 – The Court Against Organized Crime and Corruption (GJKKO) dismissed the 2 requests filed by former Prime Minister Sali Berisha.
Initially, Berisha, through his lawyers, requested the dismissal of judge Irena Gjoka which was rejected. While further, the GJKKO dismissed Berisha’s second request for lifting of the security measure against him “Compulsion to Appear and Prohibition of Exiting the State ”.
During the court session, Berisha’s lawyers, Sokol Mengjesi and Genc Gjokutaj, said that judge Irena Gjoka should be excluded from this court process. According to Berisha’s defense lawyers, Gjoka has not clarified the decision by which the security measure was sealed against Berisha and his son-in-law Jamarbër Malltezi, as well as having a conflict of interest after she was fired by Berisha in 1996, when she was the chairman of the KLD.
The same requests were made by Jamarbër Malltezi, who is under the security measure of “prison arrest”. Even for Malltezi, the GJKKO dismissed the claims for a lighter security measure and also the dismissal of the judge. In the investigation file of SPAK, where the privatization procedure of the former multi-sport club “Partizani” is being examined, the constructor, Fatmir Bekteshi is also under investigation, who is under the security measure “Compulsory appearance”.
After GJKKO’s rulings Berisha’s lawyer Genc Gjokutaj said that there was a violation. “The clear decision was told us today. Decisions are not deposited in the court’s registry. We consider that decision unexecuted. Both requests were rejected, including the one for Malltezi,” said Gjokutaj. /argumentum.al
