TIRANA – The government has taken the competencies of the judiciary through the normative act on the establishment of ‘Power of Law Operation’ (OFL). This is the main argument for President Ilir Meta to return to parliament for reconsideration this normative act considered as the most important act in the political capital of the government headed by PM Edi Rama.
The presidential decision dated March 26, 2020 was sent immediately to parliament, which has included the act in the parliamentary agenda and it is likely that the majority will turn down Meta’s ruling like they have done on similar occasions earlier.
According to the first argument of the President the normative act with the power of law has not been issued in the circumstances of emergency or legislative vacuum and has violated the power balance by taking the competence of the parliament regarding a law which should be adopted with a qualified majority of Parliament.
The other argument is the cancellation of the innocence for the persons who are subject to this law as a person cannot be considered as criminal subject without a judicial ruling.
As far as the property sequestration is concerned, which is one of the main measures of the activity of OFL, Mr. Meta underlined that the article 41 of the Constitution guaranteeing the right to private property has been openly violated.
In the concluding argument the head of state notes that the executive power grabs forcefully the constitutional and procedural responsibilities of the prosecutor for undertaking investigation and penal procedures. /argumentum.al
